Brazil has led the way in creating a specific law regulating the offer and the use of internet services. The Brazilian Internet Law has been setting the agenda for internet discussions in the country, even among non-lawyers, because of the notoriety of some decisions issued based on its terms. Currently lacking detailed regulation, the Internet Law serves as in important, yet incomplete, platform for the understanding of companies’ rights and obligations in exploiting e-commerce or online advertising.
One of the most valuable by-products of the Internet Law was the intensification of public debate surrounding data protection, online and offline. The status of the Brazilian Draft Bill of Law on Data Protection suggests that Brazil will finally enact a general law on the subject, broadening and concentrating monitoring activities towards abuses in the treatment of personal data.
