In 2021, a significant change unfolded in Brazil’s patent landscape. The Supreme Court decision, ADI No. 5529, marked the end of minimum 10-year term for invention patents, creating uncertainty, especially in pharmaceuticals, healthcare devices, and materials sectors. However, this story continued.
In response, Brazil has seen a surge in initiatives to foster domestic innovation. Proposed bills for patent term extensions are gaining momentum, promising new opportunities. Simultaneously, modernization efforts have reduced the patent backlog and sped up decision-making in the Brazilian patent system.
