On the cusp of change: patent landscape overhaul is good news for healthcare innovation in Brazil
Check out the article “On the cusp of change: patent landscape overhaul is good news for healthcare innovation in Brasil”, published on IAM Media, authored by our partners Priscila Kashiwabara and Viviane Trojan.
In 2021, a significant change unfolded in Brazil’s patent landscape. The Supreme Court decision, ADI No. 5529, marked the end of minimum 10-year term for invention patents, creating uncertainty, especially in pharmaceuticals, healthcare devices, and materials sectors. However, this story continued.
In response, Brazil has seen a surge in initiatives to foster domestic innovation. Proposed bills for patent term extensions are gaining momentum, promising new opportunities. Simultaneously, modernization efforts have reduced the patent backlog and sped up decision-making in the Brazilian patent system.
In short, Brazil is rapidly becoming a more patent-friendly jurisdiction. Legislative, executive, and judicial actions are aligning to protect intellectual property rights and encourage innovative contributions to the nation’s social, technological, and economic progress. We are here to support you in this evolving environment.
