ANVISA Publishes New Proposal for Review of the Regulation on General Labeling of Packaged Foods: Public Consultation No. 1357/2025
The proposal for reviewing the regulation concerning the general labeling of packaged foods (including beverages, ingredients, additives, and processing aids) was published this Monday, November 3, 2025, in the Federal Official Gazette (DOU). The proposal aims to replace Collegiate Board Resolution (RDC) No. 727/2022.
The regulation does not apply to packaged foods prepared and sold in the food service establishment itself and to foods packaged at the consumer’s request at the point of sale.
The new proposed text amends the labeling parameters, notably regarding what is prohibited in product presentation, the mandatory information for the consumer, and the inclusion of detailed sections.
Among the proposed modifications, the inclusion of new forbidden factors in the composition of food packaging stands out. The Agency, with the objective of protecting the consumer and guaranteeing the truthfulness of information, added restrictions on the use of words, expressions, or brands that are false or incorrect and which are sometimes employed with the intention of attracting the consumer, leading them into error.
Additionally, the proposal establishes that it is not allowed to:
- Highlight the presence or absence of components or characteristics resulting from the addition of ingredients in foods that are manufactured with similar technology, except in cases specifically provided for in regulatory standards.
- Affirm the existence of a relationship between the consumption of the food, or its components, and the manifestation of illnesses or health-related conditions, except in cases where there is a provision and support in specific standards.
- Affirm that the food or its components have metabolic or physiological effects on the growth, development, maintenance, and other normal functions of the human organism, except in cases provided for in specific standards.
- Affirm, for health-related reasons, that the food is recommended, approved, or endorsed by health professionals, associations of health professionals, or other civil society organizations, except in cases provided for in specific standards; and
- Make references to geographical locations different from its origin when they may mislead or deceive the consumer.
Within the scope of mandatory requirements, Public Consultation No. 1357/2025 establishes the duty to use the expression “USO INDUSTRIAL EXCLUSIVO” (EXCLUSIVE INDUSTRIAL USE) or equivalent for foods intended solely for industrial processing. Another relevant inclusion is the mandatory declaration of the product’s Country of Origin and the identification of the party responsible for the product.
With the objective of enabling product traceability by the consumer, as well as the identification of those responsible for its manufacture, the new regulatory proposal also adds and details new normative sections, covering:
- “Declaration of country of origin”
- “Party responsible for the product”
- “Location and legibility of mandatory information”
- “Shelf life”
These sections provide specific rules regarding the format and manner of displaying such information on the labels.
The deadline for the submission of contributions and suggestions to Public Consultation No. 1357/2025 will begin on November 10, 2025, and will run until March 9, 2026.
