BPTO Management Report 2022: Patent overview
The BPTO published, on April 11, 2023, the Management Report for fiscal year 2022, which highlights the results achieved in view of the strategic objectives and priorities defined by the patent and trademark office in the Action Plan for that year. The scenario presented indicates advances, especially in projects focused on productivity in the activities of examination of applications for industrial property rights.
In the field of patents, 27,139 applications were filed, suggesting stability in relation to the previous year, in which there were 26,921 filings. 75.2% of these filings were made by foreigners (among these, the United States ranks first, with 28.6% of filling, then China with 6%, followed by Germany with 5.9%).
As for the examination of the applications, one can notice a significant reduction in the length for a decision on the grant or rejection of the application compared to that in 2021: considering the calculation from the examination request, the BPTO reached the average of 3.9 years for a decision (in the Action Plan for 2022, the goal was 3.8 years), which represents a decrease of 22% compared to the previous year, in which average was 5 years.
The figures positively reflect the patent and trademark office’s efforts to combat the Patent Backlog, which began in 2019. For a detailed analysis about this Program, we have prepared this specific Newsletter on the subject.
By the end of 2022, over 92% of the backlog was reduced. The graph below illustrates this reduction, in the period from August 2019 to December 2022, of the number of patent applications filed until 2016 and that were still pending examination, as verified by BPTO:

According to the report, one of the main challenges in 2023 is to continue participating in international treaties on intellectual property for continuous improvement of the BPTO’s integration into the international IP system, as well as expanding international cooperation agreements for innovation.
