CONAR Tightens Betting Advertising Rules: New Restrictions on Influencers and Stronger Protections for Minors

On August 27, 2026, the National Council for Advertising Self-Regulation (CONAR) approved, significant updates to the Annex “X” of the Brazilian Advertising Self-Regulation Code and introduced a new Self-Regulatory Framework for Betting Advertising through Resolution No. 01/2026.

While preserving the core principles of the existing framework, the amendments impose stricter standards on betting advertising, particularly with respect to digital influencers and affiliates, while expanding the protection of children, adolescents, and other vulnerable groups. The new rules were developed with contributions from the industry stakeholders, public authorities, and international regulatory benchmarks.

Key changes?

1)    Greater alignment between self-regulation and government regulation.

CONAR has strengthened mechanisms for detecting, removing, preventing, and deterring advertising for illegal betting operators. In addition, betting advertisements  must comply with enhanced requirements regarding responsible gambling and mandatory warnings about the risks associated with betting. These requirements reflect the standards established by Ordinance SPA/MF No. 1,964/2026, which updated the advertising and marketing rules applicable to betting operators (“bets”), further aligning CONAR’s self-regulatory framework with government`s regulatory framework for the sector.

2)    Increased scrutiny of influencers and affiliates.

Betting related advertising carried out by influencers and affiliates is now subject to an accreditation and post-monitoring program. The new rules acknowledge that advertising in the digital environment frequently reaches consumers through third-party content, rather than solely through materials created directly by licensed operators. As a result, betting companies should strengthen  their due diligence procedures when selection partners, provide clear guidance on applicable rules, and ensure that contracts include adequate regulatory and compliance obligations.

3)    Expanded protection for children and adolescents.

CONAR has adopted a specific compliance checklist designed to reduce minors’ exposure to betting advertising.

Advertising elements that may appeal to this audience are now restricted to operators’ proprietary channels, with age-gating mechanisms in place. Compliance assessments will also consider the broader context of advertising communication, including characters, visual elements, language used, media channels, and applicable age restrictions.

Practical Implications for Companies

Betting operators and other participants in the advertising ecosystem should reassess their compliance programs.

Companies should review their campaigns and marketing materials, agreements with influencers and affiliates, monitoring and supervision mechanisms, responsible gambling warnings and mandatory disclosures, and age-targeting and age-restrictions controls. Companies should also revisit their internal approval procedures and maintain ongoing monitoring to ensure that advertising content do not create inappropriate appeal to minors.
