2023 – 2025 Action Plan for the Brazilian Intellectual Property National Strategy Announced by GIPI
The Interministerial Group on Intellectual Property (“GIPI’, in the Portuguese acronym), has announced its 2023-2025 Action Plan for implementing the Brazilian Intellectual Property National Strategy (ENPI). The Action Plan was recently published in the BR Official Gazette (GIPI/MDIC Resolution No. 8, of October 18, 2023) and will take effect on November 1, 2023.
The plan has 63 planned activities and 161 deliverables, oriented by three main goals:
Achievement of the three goals will be monitored by the end of the biennium. The actions were bundled into seven guiding pillars:
- INTELLECTUAL PROPERTY FOR COMPETITIVENESS AND DEVELOPMENT
Encourage the development and strategic use of intellectual property (IP) in the national interest to promote competitiveness and business development of Brazil and worldwide.
- INTELLECTUAL PROPERTY DISSEMINATION, TRAINING, AND CAPACITY BUILDING
Promote actions to disseminate IP culture to economic agents, consumers, the academic community, and society as a whole, with the aim of raising awareness of the IP system and its tools among inventors, creators, scientists, and entrepreneurs, as well as training professionals from various fields.
- GOVERNANCE AND INSTITUTIONAL STRENGTHENING
Ensure the alignment, articulation, and implementation of ENPI actions with the objectives and guidelines of innovation, development, competitiveness, and culture, and take measures to modernize and strengthen the administrative bodies responsible for IP services.
- MODERNIZATION OF LEGAL AND INFRA-LEGAL FRAMEWORKS
Update the IP regulatory framework to make it more open, secure, and reliable in the context of a dynamic and innovative global market, and wherever possible, simplify procedures to facilitate access to and use of the system.
- COMPLIANCE AND LEGAL CERTAINTY
Raise awareness of the importance of Intellectual Property Rights (IPR) in society, including the advantages of using IPR and the consequences of infringing them, and the need for their adequate protection. Strengthen the business environment and legal certainty in Brazil, including in the digital environment, through measures that better equip and organize judicial and inspection bodies. Coordinate actions to suppress administrative and criminal violations of intellectual property.
- INTELLIGENCE AND A VISION FOR THE FUTURE
Promote the publication of prospective analyses on IP use to identify technological trends, challenges for protecting new technologies; and new ways to acquire creations protected by IPR. Stimulate the use of databases to support innovation and the creative economy.
- BRAZIL’S INTEGRATION INTO THE GLOBAL IP SYSTEM
Strengthen Brazil’s strategic position in international IP forums, promote Brazilian cultural productions and innovations abroad, and create a favorable domestic business environment to attract foreign investment.
